The Colombian Senate has approved, virtually unanimously, the constitutional reform that creates a special judicial system to deal with war crimes, one of the key elements of the peace agreement with the FARC.
The text had already been adopted by the lower house. The reform provides for three new mechanisms: a Truth Commission, a Unit for the Search for Persons Considered Disappeared, and a Special Jurisdiction for Peace (JEP). The JEP will administer justice in a “transitional and autonomous” manner regarding events that occurred within the framework of the armed conflict before December 1, 2016. In December, the amnesty law stipulated in the peace agreement was approved. Those accused of crimes against humanity cannot benefit from the amnesty; they will be tried by the JEP, which may sentence them to alternative prison terms, provided they confess the whole truth about the crimes being prosecuted.
