New webinar organized by the Brazil-Spain Chamber of Commerce
The CCBE is working to exhaustively analyze each of the present and future measures to help and advise partners in the areas that need it most.
Under the title "“Extraordinary legal measures and labor alternatives in Brazil and Spain in the face of the COVID-19 crisis”, the Brazil-Spain Chamber of Commerce (CCBE) has organized a new webinar, which has had the participation of the Brazilian firm Soto Frugis Advogados and the Spanish firm Uría Menéndez.
Thanks to this initiative, the CCBE aims to “continue informing and advising companies on news that revolves around the coronavirus, thus sharing the experience of other partners to help many others,” he declared. Carolina Carvalho, consultant to the Chamber.
Emphasizing Brazil, Eduardo Soto Pires, partner at Soto Frugis Advogados, has spoken about Provisional Measure 927, of March 22, 2020, which includes “labor measures that employers can adopt to preserve employment and income, in order to face the State of Public Calamity, recognized on March 20, as well as the public health emergency of international importance, after the COVID-19, decreed by the Ministry of State for Health on February 3,” said Soto.
In this sense, in order to face the economic effects, the Brazilian businessmen They can adopt measures such as teleworking, anticipation of individual vacations, granting of collective vacations, use and anticipation of holidays, pool of hours, suspension of administrative and safety and health requirements at work and the deferral of payment of the Dismissal Compensation Fund (Fundo de Garantía por Tempo de Serviço).
For its part, Mario Barros García, partner of Uría Menéndez, has analyzed the measures that have been approved in Spain since March 14, the date on which the State of alarm, and in which the Royal Decree 463 / 2020, of March 14, also indicating the management of the health crisis situation caused by the coronavirus.
As a result of this decree, three other regulations have been approved. “According to my experience, they are decrees that have been issued very quickly and, therefore, can generate uncertainty,” said Barros.
To date, these standards are:
• Real Decreto-ley 10/2020, of March 29, which regulates a recoverable paid leave for employed people who do not provide essential services, in order to reduce the mobility of the population in the context of the fight against COVID-19.
• Real Decreto-ley 9/2020, of March 27, by which complementary measures are adopted, in the workplace, to alleviate the effects derived from COVID-19.
• Real Decreto-ley 8/2020, of March 17, of urgent extraordinary measures to address the economic and social impact of COVID-19.
Without a doubt, as a result of the coronavirus crisis, measures in the workplace, both Brazilian and Spanish, are changing practically every day. However, the CCBE is working to exhaustively analyze each of the present and future measures to help and advise partners in the areas that need it most.
