Terms of use of the Exterior business, the AI ​​company Exterior

Effective from June 18, 2024

We have updated the Supplemental Terms for the Outdoor Enterprise AI, effective as of September 28, 2023. You can review the previous version of these Terms here. These updated Terms completely replace all prior versions.

These Supplemental Terms for Enterprise AI (the “Terms”) apply to: (1) Enterprise AI features or capabilities labeled as “Alpha AI” or (2) where Enterprise AI has required your acceptance of the Terms before you can use a related feature or capability. These Terms supplement and/or modify your agreement with Enterprise AI, including the Terms of Service or other agreement, as applicable, for the Service (in each case, the “Agreement”). All capitalized terms used herein and not otherwise defined shall have the meanings assigned to them in the Agreement.

By accessing or using the AI ​​Features, you agree to these Terms on behalf of the applicable entity or organization that you represent.

1. AI Features

From time to time, Empresa Exterior may introduce features and capabilities as part of the Service that use artificial intelligence, machine learning, or other similar technologies (collectively, the “AI Features”). These AI Features may be developed by Empresa Exterior and/or by third-party providers, and are part of the Service. These Terms apply only to the AI ​​Features provided within the Service and not to any artificial intelligence or machine learning technologies provided by third parties. Empresa Exterior and its licensors are the sole owners of all right, title, and interest in and to the AI ​​Features, including all associated intellectual property rights.

2. AI Content

You may provide User Content for use with the AI ​​Features (the “Input”) and receive the output generated by the AI ​​Features based on such Input (the “Output,” and together with the Input, the “AI Content”). By using the AI ​​Features, as between the parties and to the extent permitted by applicable law, you are the owner of the AI ​​Content. You are solely responsible for your AI Content, including compliance with applicable laws, the General Data Protection Regulation (GDPR), and the Agreement. Other users who provide similar Input to the AI ​​Features may receive similar Output. Responses generated for other users do not constitute your AI Content.

3 License

You authorize Empresa Exterior and its third-party providers to process your AI Content in order to provide you with the AI ​​Functions. To the extent that your Input contains Personal Information (as defined in the Data Processing Addendum and in accordance with the Organic Law on Data Protection and Guarantee of Digital Rights - LOPDGDD), you instruct Empresa Exterior and its providers to process such Personal Information in order to provide the AI ​​Functions and the Output. You agree that Empresa Exterior may use subprocessors to facilitate the provision of the AI ​​Functions.

4. Disclaimer

THE AI SERVICES ARE PROVIDED TO YOU "AS IS." OUTSIDE COMPANY MAKES NO WARRANTY REGARDING THE RESULTS OBTAINED FROM USING THE AI FEATURES, OR THE ACCURACY OR SUITABILITY FOR YOUR NEEDS OF ANY INFORMATION (INCLUDING, BUT NOT LIMITED TO, MATERIALS, DESIGNS, WORKFLOWS/PROCESSES, CODE OR OTHER DATA) OBTAINED THROUGH THE AI FEATURES. YOU UNDERSTAND AND AGREE THAT ANY INFORMATION OBTAINED THROUGH THE USE OF THE AI FEATURES IS AT YOUR OWN RISK. DO NOT RELY ON FACTUAL CLAIMS OR DESIGNS, WORKFLOWS/PROCESSES OR GENERATED CODE WITHOUT INDEPENDENT VERIFICATION OF THEIR FUNCTIONALITY AND SUITABILITY FOR YOUR NEEDS.

5. Improvement of Services

Empresa Exterior may process, store and use AI Content to develop, improve and enhance the Service and AI Features. You expressly consent to such use by Empresa Exterior for this purpose. Empresa Exterior will not allow its subprocessors to use your User Content to train their AI models.

6. Restrictions on Use

You may not use the AI ​​Features or Output: (a) to develop large-scale models that compete with Outside Company or the AI ​​Features, (b) to deceive any person by making the Output appear solely human-generated, (c) in a manner that violates any technical documentation or usage guidelines, (d) to make automated decisions that may negatively impact individual rights without human oversight, or (e) in a manner that infringes the rights of Outside Company or any third party.

7. Early Access Release

You acknowledge and agree that the AI ​​Features are in an Early Access Release phase. You are not obligated to use, test or rehearse any of the AI ​​Features, and you do so at your own risk. These Terms and your access to the AI ​​Features may be terminated by Empresa Exterior at any time for any reason.

8. General

All terms of the Agreement not modified by these Terms will remain in full force and effect. The Agreement, together with these Terms, constitutes the final agreement between the parties relating to the use of the AI ​​Features.

9 Modifications

We may modify or update these Terms from time to time. Your continued use of the AI ​​Features after such changes constitutes your acceptance of the modifications.
